Referral Partner Program Terms & Conditions

These Referral Partner Program Terms & Conditions ("Agreement") govern your participation in the Riggins Strategic Solutions Professional Partner Network. By registering as a Partner, referring clients, or accepting any benefit from Riggins Strategic Solutions ("Company"), you agree to be bound by these terms.

1. Program Structure & Classification

The Partner Network consists of three distinct tiers. Your classification determines your eligibility for compensation and your ethical obligations.

Tier 1: Strategic Partner (No-Fee / Ethical Compliance)

  • Eligibility: Attorneys (Estate, Elder Law, Probate), CPAs, Trust Officers, and other fiduciaries prohibited from accepting referral fees.

  • Compensation: ZERO ($0.00). Strategic Partners are strictly prohibited from receiving any financial compensation, kickbacks, or "things of value" for referrals.

  • Benefit: In lieu of compensation, Riggins Strategic Solutions provides a Client Discount (10-15%) directly to the referred client.

  • Ethical Compliance: This structure is designed to comply with NC State Bar Rule 5.4 (Professional Independence of a Lawyer) and AICPA Code of Professional Conduct regarding referral fees and independence.

Tier 2: Affiliate Partner (Commission-Based)

  • Eligibility: Senior Move Managers, Professional Organizers, Content Creators, and non-fiduciary professionals.

  • Compensation: Affiliate Partners are eligible to receive a commission (percentage or flat fee) on the sale of digital products (e.g., The Premium Blueprint) and specific consulting packages, subject to federal and state laws.

  • Independent Contractor Status: You are an independent contractor, not an employee. You are responsible for all local, state, and federal taxes on your earnings. A Form 1099-NEC will be issued if earnings exceed $600 in a calendar year.

Tier 3: Broker Partner (Real Estate Referral)

  • Eligibility: Active, licensed Real Estate Brokers (NC or Nationwide).

  • Compensation: Referral fees are paid strictly on a Broker-to-Broker basis in accordance with NCREC Rules and RESPA.

  • Requirement: A separate, signed Real Estate Referral Agreement (e.g., NCAR Form 770) is required for each transaction. No referral fee will be paid without a valid, active license and a signed agreement.

2. RESPA & Anti-Kickback Compliance

Strict Adherence to RESPA: Riggins Strategic Solutions is a consulting firm, but its founder is a licensed Real Estate Broker. To ensure strict compliance with the Real Estate Settlement Procedures Act (RESPA):

  1. No Payment for Settlement Services: No referral fee, commission, or thing of value will be paid to any person for the referral of business related to a federally related mortgage loan or real estate settlement service, unless that person is a licensed real estate broker and the payment is a compliant broker-to-broker referral fee.

  2. Consulting vs. Brokerage: "Affiliate Commissions" (Tier 2) are paid strictly for the sale of consulting services and digital education products. They are never tied to the closing of a real estate transaction or the sale of a property.

3. Non-Exclusivity & Independence

  • Non-Exclusivity: Participation in this program is non-exclusive. You are free to refer clients to other service providers.

  • No Agency: This Agreement does not create a partnership, joint venture, agency, or employment relationship. You have no authority to make representations or bind Riggins Strategic Solutions to any contract.

4. Confidentiality & Data Privacy

  • Client Data: You agree to obtain necessary client consent before sharing their contact information with Riggins Strategic Solutions.

  • HIPAA: If you are a covered entity under HIPAA, you agree not to share Protected Health Information (PHI) without a valid Business Associate Agreement (BAA) or client authorization.

5. Termination

Riggins Strategic Solutions reserves the right to terminate your participation in the Partner Program at any time, with or without cause. Upon termination:

  • Tier 2: Any unpaid, valid commissions earned prior to termination will be paid.

  • Tier 3: Pending real estate referrals with a signed agreement will be honored in accordance with that specific agreement.

6. Limitation of Liability

Riggins Strategic Solutions shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with this Agreement, even if advised of the possibility of such damages.
